Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of the Stikko mobile application and website (collectively, the "Service"), operated by Stikko ("we," "us," or "our"). By accessing or using the Service, you confirm that you are at least 13 years of age and agree to be bound by these Terms. If you do not agree, do not use the Service.

2. The Service

Stikko is an AI-powered sticker sheet generation app. You can upload photos or describe ideas, and Stikko will generate custom sticker artwork. Generated sticker sheets can be downloaded and used for personal or commercial purposes, subject to these Terms.

3. Account Registration

You may need to create an account to access certain features. You are responsible for keeping your account credentials secure and for all activity that occurs under your account. Please notify us immediately at www.stikko.shop@gmail.com if you suspect unauthorized access.

4. Credits and In-App Purchases

• Generating sticker sheets requires credits. Credits can be purchased through the App Store as consumable in-app purchases.
• All purchases are processed by Apple and are subject to Apple's payment terms and refund policies.
• Credits are non-refundable and have no cash value. Unused credits may be forfeited if your account is terminated for a violation of these Terms.
• We reserve the right to modify credit pricing or pack contents at any time with reasonable notice.

5. User Content

You retain ownership of any photos or content you upload to Stikko ("User Content"). By uploading content, you grant us a limited, non-exclusive license to process that content solely for the purpose of generating your sticker designs. We do not use your uploaded photos to train AI models or share them with third parties, except as needed to operate the Service.

You are solely responsible for ensuring you have the right to use any content you upload. Do not upload content that is illegal, infringes third-party rights, or violates these Terms.

6. Generated Content

Sticker designs generated by Stikko are provided for your personal and commercial use. We make no guarantees about the uniqueness of AI-generated designs. You are responsible for reviewing generated content before use and ensuring it does not infringe on third-party rights.

7. Prohibited Conduct

You agree not to:

• Upload content that is unlawful, harmful, abusive, harassing, defamatory, obscene, or otherwise objectionable.
• Attempt to circumvent or manipulate the credits system.
• Reverse engineer, decompile, or attempt to extract the source code of the app.
• Use the Service in any way that could damage, disable, or impair our systems.
• Use automated tools to access or scrape the Service without our written consent.

8. Intellectual Property

The Stikko name, logo, app design, and all non-user content are owned by or licensed to Stikko and are protected by intellectual property laws. Nothing in these Terms grants you the right to use our trademarks or branding without our prior written consent.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or produce results that meet your expectations.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Stikko shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the twelve months preceding the claim.

11. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. You may stop using the Service at any time. Sections relating to intellectual property, disclaimers, and limitation of liability survive termination.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the date below and, where appropriate, through in-app notification. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions.
